57-Year Old Teacher Allegedly Rapes An 11-Year Old Girl In Benue

One Fayam Ahkpe, a 57-year-old teacher, is alleged to have raped an 11 year old girl. The incident is said to have occurred at Gondozua Village in Benue State.

The accused is alleged to have gone to the farm where the girl was working and raped her.

The accused was charged by the police, with the offense before Chief Magistrate, Mrs. Mercy Igbadu, who ordered that the accused be remanded in a Correctional Facility and adjourned the matter to February 8, 2020 for further hearing.

Under the extant Penal Code applicable in the Nigerian Northern States, rape is a sexual intercourse involving penetration of a female person without her consent. Under The Child’s Right Act, a person under 18 cannot give consent and any sexual activities with such a person is considered statutory rape. The Child’s Right Act is a Federal law and because the matter covered therein are matters under the residual legislative list, it needs to domesticated by a state to apply to that state. Benue State is one of the states that has domesticated the law and therefore Mr. Ahkpe cannot raise the defence that the act was consensual, because the girl is incapable of giving consent at her age.

Rape attracts a maximum imprisonment for life.
